TERMS AND CONDITIONS OF USE

These Terms and Conditions of Use (“Terms”) govern your access to and use of the Heatlume website, online store, products, checkout functions, content, customer-support services, and related features, collectively referred to as the “Store Services.”

The Store Services are operated by Heatlume and hosted through Shopify’s ecommerce platform.

By visiting our website, creating an account, submitting an order, or otherwise using the Store Services, you acknowledge that you have read and agree to these Terms and the policies incorporated by reference. If you do not agree, please discontinue your use of the Store Services.

1. STORE OPERATOR

In these Terms, “Heatlume,” “we,” “us,” and “our” refer to the business operating the Heatlume online store. “You” and “your” refer to any visitor, customer, account holder, or other person accessing or using the Store Services.

Our current business and contact information is provided at the end of these Terms.

2. ELIGIBILITY

To make a purchase through Heatlume, you must be legally capable of entering into a binding agreement under the laws applicable in your place of residence.

If you permit a minor to browse or use the Store Services through an account or device under your control, you are responsible for that use to the extent permitted by applicable law.

You may not use the Store Services if your access has previously been suspended because of fraud, unlawful activity, abuse, a security threat, or a material violation of these Terms.

3. CUSTOMER ACCOUNTS

Certain features may allow or require you to create a customer account.

When registering, placing an order, or communicating with us, you agree to provide accurate, current, and reasonably complete information. You are responsible for updating your information when it changes.

You are responsible for:

  • Protecting your account password and login credentials;
  • Preventing unauthorized access to your account or device;
  • Reviewing activities conducted through your account; and
  • Informing us promptly if you suspect unauthorized access or misuse.

Customer accounts are intended for use by the registered customer. Accounts may not be sold, rented, transferred, or used to impersonate another person.

We may temporarily restrict or suspend an account when reasonably necessary to investigate suspected fraud, security risks, unlawful activity, misuse, or violations of these Terms.

4. PRODUCT INFORMATION

Heatlume makes reasonable efforts to present accurate product descriptions, photographs, colors, specifications, measurements, prices, and availability information.

However, actual product appearance may vary slightly because of screen settings, photography, lighting, production batches, supplier updates, or reasonable manufacturing variations. Product packaging may also change without affecting the essential characteristics of the product.

Before purchasing, please review the product description, dimensions, materials, compatibility information, warnings, and usage instructions.

Heatlume may update product information, correct descriptions, limit quantities, or discontinue products. These changes will not affect rights that have already arisen under applicable law.

If a product you receive is materially different from its description, please contact us in accordance with our Return and Refund Policy.

5. ORDERS AND ACCEPTANCE

Submitting an order constitutes an offer to purchase the products shown at checkout.

An automated order-confirmation message acknowledges receipt of your order but does not necessarily constitute final acceptance. Subject to applicable law, an order is accepted when we confirm that it has entered fulfillment or has been dispatched.

Before submitting an order, you are responsible for confirming:

  • The selected products and quantities;
  • The size, color, model, and other product options;
  • The billing and shipping addresses;
  • Your telephone number and email address;
  • The selected delivery method; and
  • The total amount displayed at checkout.

Heatlume may decline or cancel an order for a legitimate reason, including:

  • Product unavailability;
  • An obvious pricing, description, or system error;
  • Payment authorization failure;
  • Suspected fraud or unauthorized payment activity;
  • An order exceeding purchase or quantity limits;
  • Delivery restrictions affecting the destination;
  • Applicable legal or regulatory restrictions; or
  • Misuse of a discount, promotion, referral, or customer account.

If we cancel an order after payment has been successfully collected, we will issue a refund for the applicable canceled amount to the original payment method. Additional processing time may be required by your bank or payment provider.

6. PERSONAL AND HOUSEHOLD USE

Unless Heatlume agrees otherwise in writing, products offered through our store are intended for personal or household use.

You must not use false identities, manipulate promotions, employ unauthorized automated purchasing systems, or place orders for fraudulent purposes, illegal export, or unauthorized commercial resale.

We may limit or cancel quantities that reasonably appear to have been ordered by resellers, distributors, automated purchasing systems, or multiple accounts controlled by the same person.

7. PRICES, TAXES, AND PAYMENT

The price charged for a product will normally be the price displayed at checkout when the order is submitted.

Prices and promotions may change before an order is placed. Discounts and promotional offers may be subject to eligibility requirements, expiration dates, quantity limitations, and separate terms.

Unless expressly stated otherwise, displayed product prices may not include:

  • Shipping or handling charges;
  • Sales, use, value-added, or similar taxes;
  • Customs duties;
  • Import charges; or
  • Fees imposed by banks, card issuers, or currency-conversion providers.

Charges collected directly by Heatlume will be shown during checkout when reasonably possible. Unless otherwise stated or required by law, customers are responsible for duties, taxes, or fees imposed directly by customs authorities or other third parties.

By submitting payment information, you confirm that:

  • You are authorized to use the selected payment method;
  • The payment and billing information is accurate;
  • You authorize the applicable order amount to be charged; and
  • You will not knowingly initiate a false or abusive payment dispute.

Payments are processed through Shopify and applicable third-party payment providers. Heatlume generally does not directly receive or store complete payment card numbers.

8. ORDER CHANGES AND CANCELLATIONS

If you need to change or cancel an order, contact us as soon as possible at spbgvpwlm@outlook.com.

We will make reasonable efforts to assist, but we cannot guarantee a change or cancellation after an order enters processing, fulfillment, or shipping.

An order that has already been shipped normally cannot be canceled while it is in transit. After delivery, any request to return the product will be reviewed under our Return and Refund Policy.

Refusing delivery without prior authorization does not automatically qualify an order for a full refund. Where permitted by law, reasonable shipping, customs, carrier, or return costs resulting from an unauthorized refusal may be deducted from the refundable amount.

Nothing in this section limits any cancellation right that cannot legally be excluded.

9. SHIPPING AND DELIVERY

The estimated delivery timeframe is generally 7–15 calendar days after shipment.

This timeframe is an estimate and is not a guaranteed delivery date. Actual delivery times may vary according to:

  • The delivery destination;
  • Carrier operations;
  • Customs processing;
  • Weather conditions;
  • Public holidays;
  • Local delivery conditions;
  • Product availability; or
  • Other events beyond our reasonable control.

Tracking updates are provided by the applicable carrier and may not appear immediately after dispatch. The actual delivery schedule will depend on the circumstances of each shipment.

You are responsible for providing an accurate and complete delivery address. If you identify an error, contact us immediately. We cannot guarantee that an address can be changed after an order has entered processing or shipping.

If a package is materially delayed, confirmed lost, returned to sender, or marked as delivered but cannot be located, please contact us. We will review the available tracking information and provide assistance based on the circumstances and applicable law.

Nothing in this section excludes delivery, cancellation, replacement, or refund rights that are mandatory under applicable consumer law.

10. RETURNS, REFUNDS, AND PRODUCT ISSUES

Returns, refunds, replacements, and exchanges are governed by our Return and Refund Policy.

Heatlume does not generally provide unconditional returns solely because a customer changes their mind, no longer wants a product, or selected an incorrect size, color, style, or quantity.

Customers may contact us to explain their circumstances, and we may review non-quality-related requests individually. Submitting a request does not guarantee approval.

If a product arrives damaged, defective, incorrect, or materially different from its description, please contact us promptly and provide the requested order information, photographs, videos, or other reasonable supporting evidence.

Do not return any product before receiving return authorization and the applicable return instructions from Heatlume.

Nothing in this section excludes or restricts mandatory consumer rights, including any statutory cancellation, withdrawal, repair, replacement, or refund rights that apply in your jurisdiction.

11. ACCEPTABLE USE

You may use the Store Services only for lawful shopping, customer-service, account-management, and informational purposes.

You must not:

  • Use the website for fraud, deception, unlawful conduct, or malicious activity;
  • Submit false payment, billing, account, or shipping information;
  • Impersonate another person or misrepresent your identity;
  • Infringe intellectual-property, privacy, publicity, or other legal rights;
  • Upload malware, viruses, corrupted files, or harmful code;
  • Attempt to gain unauthorized access to an account, system, or network;
  • Bypass security controls, fraud checks, purchase limits, or access restrictions;
  • Interfere with the operation, security, or availability of the website;
  • Collect another person’s information without authorization;
  • Send spam, phishing messages, or unauthorized advertising;
  • Scrape, reproduce, monitor, or extract store content using unauthorized automated tools;
  • Manipulate reviews, promotions, discounts, referrals, or checkout functions; or
  • Use the Store Services in a manner that may harm Heatlume, Shopify, service providers, customers, or third parties.

We may restrict access, suspend accounts, or cancel affected transactions when reasonably necessary to address fraud, prohibited conduct, security risks, violations of these Terms, or legal obligations.

12. INTELLECTUAL PROPERTY

The Heatlume website and its original content—including text, layouts, product presentations, photographs, graphics, logos, videos, design elements, and other materials—are owned by or licensed to Heatlume and protected by applicable intellectual-property laws.

Heatlume grants you a limited, revocable, non-exclusive, and non-transferable permission to access the website for personal, non-commercial, and lawful shopping purposes.

Without prior written authorization, you may not:

  • Reproduce or republish substantial portions of website content;
  • Sell, license, distribute, or commercially exploit store materials;
  • Remove copyright, trademark, or ownership notices;
  • Create misleading copies of the website;
  • Use Heatlume’s branding to imply an unauthorized relationship; or
  • Create commercial derivative materials using protected store content.

Third-party names, trademarks, and materials remain the property of their respective owners. Shopify’s name and trademarks belong to Shopify.

13. CUSTOMER REVIEWS AND SUBMISSIONS

If you provide Heatlume with a review, photograph, comment, suggestion, idea, or other content, you confirm that:

  • You created the content or have permission to submit it;
  • The content is accurate to the best of your knowledge;
  • Any compensation or incentive related to the submission has been disclosed;
  • The content does not infringe another person’s rights;
  • The content is not unlawful, threatening, defamatory, obscene, deceptive, or abusive; and
  • The content does not contain malware or harmful code.

You grant Heatlume a non-exclusive, worldwide, royalty-free license to store, reproduce, display, format, and use the submitted content for operating, improving, and promoting our store, subject to applicable privacy and consumer-protection laws.

This license does not transfer ownership of your original content to Heatlume.

We may moderate, decline to publish, or remove submissions that violate these Terms, applicable law, platform requirements, or the rights of others.

14. THIRD-PARTY SERVICES AND LINKS

The Store Services may provide access or links to payment providers, shipping websites, social networks, applications, or other independently operated services.

Third-party services are governed by their own terms and privacy policies. Heatlume does not control their independent content, availability, security, or business practices.

Providing a link or technical integration does not necessarily mean that Heatlume endorses every product, statement, or activity of the third-party provider. You should review the provider’s applicable terms before using an external service or entering into a separate transaction.

15. RELATIONSHIP WITH SHOPIFY

Heatlume is powered by Shopify, which enables us to provide the Store Services to you. However, any sales and purchases made through our store are made directly between you and Heatlume.

By using the Store Services, you acknowledge and agree that Shopify is not responsible for any aspect of the sales or transactions between you and Heatlume, including any injury, damage, loss, claim, return, refund, fulfillment issue, or customer-service matter arising from products or services purchased from Heatlume.

To the fullest extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or relating to purchases and transactions made with Heatlume.

Nothing in this section limits any rights or remedies that cannot legally be excluded under applicable consumer law.

16. PRIVACY AND PERSONAL INFORMATION

Our collection and handling of personal information are described in our Privacy Policy.

Because the Store Services use Shopify, Shopify may also process certain personal information relating to your website access, checkout, payments, and use of the ecommerce platform.

By using the Store Services, you acknowledge that relevant personal information may be processed by Heatlume, Shopify, payment providers, fulfillment partners, shipping carriers, and other service providers as described in the applicable privacy notices.

17. ERRORS AND SERVICE AVAILABILITY

Website information may occasionally contain typographical mistakes, outdated availability information, incorrect promotional details, or other inadvertent errors.

Heatlume may correct errors and update store information when they are discovered. If a material error affects an order that you have already submitted, we may contact you to confirm the corrected information or cancel the affected portion and issue the applicable refund.

We do not guarantee that every website function will always be available, uninterrupted, secure, or completely free from technical errors. We may maintain, update, restrict, or discontinue a feature when reasonably necessary.

18. WARRANTIES AND STATUTORY RIGHTS

Except for warranties expressly provided by Heatlume and rights that cannot legally be excluded, the website and its general informational content are provided on an “as available” basis.

To the extent permitted by law, Heatlume does not provide additional implied guarantees that website access will always be uninterrupted, entirely free from technical errors, or suitable for a particular purpose.

Depending on your location, products may be subject to statutory warranties, consumer guarantees, and mandatory remedies. Nothing in these Terms excludes, restricts, or modifies a right or remedy that cannot legally be excluded.

19. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Heatlume will not be responsible for indirect, incidental, special, punitive, or consequential losses arising from the use of the Store Services, including lost profit, revenue, data, opportunity, or business, where such losses were not reasonably foreseeable or are otherwise legally excludable.

Heatlume’s liability for a valid claim relating to a purchased product will not exceed the amount paid for the affected product, except where a different remedy or limitation is required by law.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, intentional misconduct, or other matters for which limitation is prohibited.

20. RESPONSIBILITY FOR VIOLATIONS

To the extent permitted by law, you are responsible for losses or third-party claims reasonably resulting from:

  • Your unlawful use of the Store Services;
  • Your material violation of these Terms;
  • Your infringement of another party’s rights; or
  • Content you submit without the necessary rights or authorization.

This section does not require you to compensate Heatlume for losses caused by Heatlume’s own unlawful conduct, negligence, or breach of legal duty where such exclusion is prohibited.

21. SUSPENSION AND TERMINATION

You may stop using the Store Services at any time.

Heatlume may suspend or terminate access when reasonably necessary because of fraud, security risks, unlawful activity, repeated misuse, failure to pay valid amounts, or a material violation of these Terms.

Termination does not cancel payment obligations or legal rights that arose before termination. Provisions concerning intellectual property, submitted content, liability, disputes, and other terms that logically must continue will remain effective after access ends.

22. GOVERNING LAW AND JURISDICTION

These Terms are governed by the applicable laws of the State of Colorado and the federal laws of the United States, without regard to conflict-of-law principles.

Subject to mandatory consumer rights concerning jurisdiction or venue, disputes relating to these Terms or the Store Services may be brought before courts having lawful jurisdiction in Colorado.

If the law of your country or region provides mandatory rights or permits you to bring a claim in your local courts, this section does not remove those rights.

23. CHANGES TO THESE TERMS

Heatlume may update these Terms to reflect changes in our Store Services, business practices, policies, service providers, or legal obligations.

Updated Terms will be posted on this page with a revised effective date. Where required by law, we will provide additional notice before a material change becomes effective.

Changes will apply prospectively unless applicable law permits otherwise. Your continued use of the Store Services after updated Terms take effect constitutes acceptance to the extent permitted by law.

24. GENERAL PROVISIONS

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply. The affected provision will be enforced or adjusted only to the extent legally permitted.

Heatlume’s failure to enforce a provision on one occasion does not waive the right to enforce that provision later.

These Terms, together with the policies and additional terms expressly incorporated by reference, form the agreement governing your use of the Store Services.

You may not assign your rights or obligations under these Terms without our prior written consent. Subject to applicable law, Heatlume may assign these Terms as part of a legitimate merger, acquisition, restructuring, asset transfer, or business succession.

Section headings are included for convenience and do not change the interpretation of these Terms.
